Erik Mendendez and his brother Lyle Menendez will remain incarcerated this year.
A resentencing hearing originally scheduled for December for the Menendez brothers has been postponed to January 30 by a Los Angeles court. The court has also set a preliminary hearing in January to consider briefings from both the prosecution and the defense attorneys.
The decision to delay the hearing, which was initially set for December 11, was made by Judge Michael Jesic on Monday. The postponement will give the new LA County District Attorney Nathan Hochman, who assumes office on December 3, adequate time to familiarize himself with the details of this high-profile case.
